MALS BY BJORN BV, trading as BeMarketing (“we”), is responsible for processing the personal data you provide to us via bemarketing.be or in any other way. In this policy, you can read what data we process, why, with whom we share it and what rights you have.
1. Who we are
MALS BY BJORN BV
Ambachtsweg 7, 3890 Gingelom, Belgium
Company number and VAT: BE0754.501.731
Phone: +32 11 49 77 40
Privacy questions: privacy@malsbybjorn.com. Your contact person is Bjorn Engels.
2. What data we process, and why
If you fill in the contact form
We process your name, company, email address, phone number (if you provide it) and your message, together with the page from which you sent the form, the referring website and any campaign parameters in the link (such as utm_ or mtm_). We use this data to answer your question and, if you wish, to prepare a collaboration.
Legal basis: steps taken at your request prior to entering into a contract, and our legitimate interest in answering questions.
If you book a call
If you book a call via our calendar, we process your name, email address, the time slot you choose and whatever you fill in yourself. The call itself takes place via a video service such as Google Meet. Legal basis: steps taken at your request prior to entering into a contract.
If you email us, call us or send us a WhatsApp message
We process the data you provide to us yourself, in order to reply to you. WhatsApp is a Meta service; if you contact us via WhatsApp, WhatsApp’s privacy policy also applies. Legal basis: our legitimate interest in answering questions.
If you are a client
We process the data of our contact persons at clients (name, job title, email address, phone number) and whatever is needed for the assignment, invoicing and accounting. Legal basis: the performance of the contract, and our legal obligations, including in the area of accounting.
If you are a client, we may occasionally inform you about similar services of ours. If you do not want this, just let us know; you can also unsubscribe in every email. Legal basis: our legitimate interest. For other marketing messages, we ask for your consent first.
If you visit the website
We measure the use of the website with Matomo, without cookies and without storing anything on your device. Your browser sends a short signal (which page, which website you came from, your screen size) to our own server, which forwards it to Matomo. Your IP address and browser type are also sent along; Matomo anonymises the IP address. We only use these figures to improve the website and to see which channels work. We do not use them to build profiles and do not share them with advertising networks. Legal basis: our legitimate interest in managing and improving the website.
Security
To prevent spam and misuse of the form, we use Cloudflare Turnstile. Turnstile checks whether the form is being filled in by a human and, to do so, processes technical data such as your IP address and browser characteristics. Our web server also keeps technical log files (including IP address and time) to keep the site secure. Legal basis: our legitimate interest in securing the website and your data.
3. Who we share data with
We never sell your data. We work with the following processors, who only use your data on our instructions:
| Service | Purpose | Location |
|---|---|---|
| Hetzner | Hosting of the website and the form | Germany |
| Twenty | Our CRM, where contact requests end up | On our own infrastructure |
| Brevo | Sending the notification of a contact request | European Union |
| Matomo Cloud (InnoCraft) | Website statistics | European Union |
| Cloudflare | Turnstile spam protection, DNS and the secure connection to our CRM and our calendar | United States and worldwide |
| Cal.com, on our own server | Calendar for calls | On our own infrastructure |
Cloudflare is an American company. Transfers of data to the United States take place on the basis of the EU-U.S. Data Privacy Framework or the standard contractual clauses of the European Commission.
We also disclose data if the law requires us to, or if it is necessary to protect our rights or the safety of others, for example in the event of fraud. If our company is taken over, merged or restructured, data may pass to the new owner, who will then be bound by this policy.
4. How long we keep data
- Contact requests that do not lead to a collaboration: up to two years after the last contact.
- Client data: for as long as the collaboration lasts, and thereafter for as long as the law requires us to (including for accounting purposes).
- Website statistics: for as long as they are useful for improving the website, with anonymised IP addresses.
5. Your rights
You have the right to access your data, to have it rectified or erased, to have its processing restricted, to object to processing based on our legitimate interest, and to data portability. If you have given us your consent, you can withdraw it at any time. You can exercise these rights via privacy@malsbybjorn.com. We respond within one month.
If you are not satisfied with how we handle your data, you can lodge a complaint with the Data Protection Authority (Gegevensbeschermingsautoriteit), Drukpersstraat 35, 1000 Brussels, contact@apd-gba.be, www.gegevensbeschermingsautoriteit.be. You can also take the matter to court.
6. Links to other websites
Our website links to other websites, such as those of clients and partners. These have their own privacy policies; we are not responsible for what happens there.
7. Changes
We amend this policy when our working methods or the law change. At the top, you can see when it was last amended. In the case of significant changes, we also announce them on the website.
